TERMS OF USE & SERVICE AGREEMENT

Welcome to Club Never Quit. By accessing our website and using our facility in Scottsdale, AZ, you agree to comply with and be bound by the following terms. These terms incorporate the provisions of our Physical Liability Waivers signed upon entry to our facility.
1. WELLNESS VS. MEDICAL SERVICES
Club Never Quit is a sports recovery and wellness facility, not a medical facility.
Recovery Services: Tools such as Cold Plunge, Saunas, Red Light Therapy, and Compression are self-directed wellness tools.
NAD+ Injections: Nicotinamide Adenine Dinucleotide (NAD) injections are provided as a wellness service.
No Physician-Patient Relationship: Use of our services does not establish a physician-patient relationship. Our services are not intended to diagnose, treat, cure, or prevent any disease.
2. NAD+ SPECIFIC DISCLOSURES
FDA Disclosure: NAD injections are not FDA-approved for the treatment or prevention of any disease. Services are for general wellness purposes only.
PCP Clearance: By booking an NAD+ service, you certify that you have discussed this therapy with your Primary Care Physician (PCP), they have reviewed your medical history, and have cleared you to receive NAD injections.
Contraindications: NAD+ may not be appropriate if you are pregnant, breastfeeding, have active cancer, severe liver disease, or unstable cardiovascular conditions.
3. PAYMENTS, REFUNDS & ACCOUNT MANAGEMENT
Service Provider: All bookings, payments, and personal account management are processed through our partner, WellnessLiving. By using our services, you also agree to WellnessLiving’s terms and conditions.
Refund Policy: We offer a full refund for any service or package within 7 days of purchase, provided the service has not been used. After 7 days or once a service has been utilized, all sales are final.
Price Changes: Club Never Quit reserves the right to modify prices, membership tiers, and available modalities at any time without prior notice.
4. CANCELLATION & MEMBERSHIP POLICIES
To ensure the best experience for all members, we enforce the following cancellation windows:
Recovery Sessions: You may cancel or reschedule a Recovery Flow session up to 1 hour prior to your appointment.
NAD+ Injections: We require at least 24 hours’ notice for any cancellation or rescheduling of NAD+ appointments.
Membership Cancellations: To stop future billing, cancellation requests must be submitted at least 72 hours prior to your next scheduled billing date.
Late Policy: Failure to cancel within these timeframes or "No-Shows" will result in the forfeiture of the session credit or a charge to the card on file.
5. ACKNOWLEDGMENT OF RISKS & LIABILITY
You voluntarily assume all risks associated with recovery services (extreme temperatures, slippery surfaces) and NAD+ injections (bruising, nausea, injection site discomfort). You release Club Never Quit, its owners, and staff from any and all claims related to injury, illness, or property loss arising from your participation.
6. PERSONAL CONDUCT & MEDIA
Conduct: We reserve the right to refuse service to anyone who violates safety guidelines, hygiene requirements (rinsing before Cold Plunge), or demonstrates disrespectful behavior.
Media Use: We may record activities for promotional use. If you wish to opt-out, please notify our staff at check-in.
Minors: Participants under 18 must have parental/guardian consent and a signed waiver.
7. GOVERNING LAW
These terms are governed by the laws of the State of Arizona. Any legal proceedings shall take place in the courts of Maricopa County, Arizona.
